1. Acceptance of Terms

By downloading, installing, or using the Fovly application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Fovly is an iOS application that enables speed reading using Rapid Serial Visual Presentation (RSVP) technology. The App allows you to import and read books in various formats (EPUB, FB2, MOBI, TXT) at adjustable reading speeds, with additional features including AI-powered insights, reading statistics, and customizable themes.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.

4. Subscriptions & Free Trial

Fovly requires an active subscription to use. New users receive a free trial period to explore the full app before being charged. The App offers two auto-renewing subscription plans:

Both plans include all features: unlimited books, reading speeds up to 1,200 WPM, all color themes and fonts, AI-powered features, detailed reading statistics, and customizable reading experience.

Subscriptions are processed through Apple's App Store. Payment is charged to your Apple ID account at the end of the free trial period. Subscriptions auto-renew unless turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings. If you cancel during the trial, you will not be charged.

Books and text you import into Fovly remain yours. We do not claim any ownership or rights over the content you read using the App. Your reading data, bookmarks, notes, and settings are stored locally on your device and, if enabled, in your private iCloud account.

7. AI Features

Fovly includes AI-powered features (summaries, explanations, comprehension quizzes) that send text excerpts to third-party AI services for processing. By using these features, you acknowledge that relevant text from your books may be transmitted to Google's Gemini API. We do not store or retain this data. AI-generated content is provided for informational purposes and may not always be accurate.

8. Intellectual Property

The Fovly name, logo, design, and underlying code are the property of Fovly and its creators. You may not copy, modify, distribute, or create derivative works from any part of the App without prior written consent.

9. Disclaimer of Warranties

Fovly is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

To the maximum extent permitted by applicable law, Fovly and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or interruption of service.

We reserve the right to modify, update, suspend, or discontinue any part of the App at any time. We may also update these Terms of Service, and continued use of the App after changes constitutes acceptance of the updated terms.

12. Termination

We reserve the right to restrict or terminate access to the App for any user who violates these terms. You may stop using the App at any time by deleting it from your device.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
